Terms and Conditions for Math + Snake

Thank you for choosing to play Math + Snake (the “Game”) by FlappyDevs - PAL NICOLAE OVIDIU PFA! These Terms and Conditions (“Terms”) govern your access and use of the Game. By downloading, installing, or using the Game, you agree to these Terms. If you do not agree, please refrain from using the Game.

1. Introduction and Acceptance of Terms

By using the Game, you agree to comply with these Terms. If you are under the age of 13 (or 16 in certain regions), you must have permission from a parent or legal guardian to use the Game. These Terms form a legally binding agreement between you and PAL NICOLAE OVIDIU PFA.

2. License to Use the Game

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to download, install, and use the Game on your device for personal, non-commercial entertainment purposes only.

You agree that you will not:

Copy, modify, distribute, or create derivative works of the Game.
Reverse-engineer, decompile, or disassemble the Game or attempt to extract the source code.
Use the Game for any commercial purposes or public performances without our express permission.

We reserve all rights not expressly granted to you.

3. User Conduct

You agree to use the Game in a lawful and respectful manner. By using the Game, you agree not to:

Engage in cheating, hacking, or exploiting glitches or bugs.
Upload, share, or distribute the game files on third party web sites or stores without our explicit consent.
Attempt to disrupt the operation of the Game, including by sending viruses or malicious code.

We reserve the right to suspend or terminate your access to the Game if we determine, at our sole discretion, that you have violated these Terms or engaged in inappropriate conduct.

4. Virtual Goods and In-App Purchases

The Game may offer virtual goods, such as in-game currency, items, or other digital content.

Virtual goods:

Have no real-world monetary value and cannot be exchanged for real money or other tangible goods.
Are non-transferable and non-refundable, except as required by law.
May be purchased via the app stores or platforms where the Game is available.

All purchases are final and governed by the app store’s terms.

We reserve the right to modify or remove virtual goods at any time without notice.

5. Subscription Purchases

Once the free trial period expires the Game is available with a monthly or a yearly auto-renewable subscription.

You can cancel the subscription at any time.

By subscribing and using the Game you agree to App Store: Terms of Service and Refund Policy.

Your refund and 14 days withdrawal rights vary by country and product type. Please consult the Terms of Service and Refund Policy for more details.

You will be notified about any price changes giving you the option to cancel your subscription before the new prices would go into effect.

You can cancel the subscription at any time through your app store account settings

6. Ownership and Intellectual Property

All content and intellectual property rights in the Game, including software, graphics, designs, music, and trademarks, are owned by PAL NICOLAE OVIDIU PFA or its licensors.

The Game is also using music from third parties under the Creative Commons which have been listed in the Credits menu.

You acknowledge that you do not acquire any ownership rights in the Game by playing it. The Game is licensed to you, not sold.

Any feedback or suggestions you provide related to the Game are voluntary, and we may use them without any obligation to you.

7. Updates and Modifications

We may update, modify, or discontinue the Game or certain features at any time, with or without notice. This may include bug fixes, new features, or removing certain elements of the Game.

Updates may be automatically installed, and by using the Game, you agree to receive these updates. Continued use of the Game following any updates indicates your acceptance of any changes.

8. Termination of Use

We reserve the right to suspend or terminate your access to the Game, at our discretion, if you violate these Terms or if we discontinue the Game.

Termination due to violation of these Terms may result in the forfeiture of any refunds for in-app purchases or virtual goods.

You may terminate your use of the Game at any time by uninstalling it from your device.

9. Limitation of Liability

The Game is provided on an "as is" and "as available" basis. We make no warranties or guarantees of any kind regarding the Game’s operation, availability, or performance.

To the maximum extent permitted by law, PAL NICOLAE OVIDIU PFA and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

Use or inability to use the Game.
Any bugs, errors, or interruptions in the Game.
Loss of data or virtual goods.

During the trial period, if you are dissatisfied with the Game, your sole remedy is to discontinue use

If you have an active subscription our total liability to you in connection with the Game for all damages, losses and causes of action will not exceed the lesser of the subscription fee paid by you or USD $100.

You also agree that any claim you may have arising out of or related to your relationship with PAL NICOLAE OVIDIU PFA (FlappyDevs) must be filed within one year after such claim arose; otherwise, your claim is permanently barred.

10. Privacy

Your privacy is important to us. Please refer to our Privacy Policy to learn more about how we collect, use, and protect your information when you use the Game.

By installing and playing the Game, you agree to the terms of our Privacy Policy.

11. Dispute Resolution

These Terms are governed by the laws of Romania. Any disputes arising from these Terms or your use of the Game will be resolved through binding arbitration, to the extent permitted by law.

You agree to waive your right to participate in class-action lawsuits related to your use of the Game.

12. Changes to Terms

We may modify these Terms from time to time. If changes are made, we will notify you by posting the updated Terms in the Game or on our website.

Your continued use of the Game after such changes indicates your acceptance of the new Terms.
